These Terms of Service ("Terms") form a binding agreement between you and West Liners LLC, doing business as SUPER LINER ("Company," "we," "us," or "our"), and govern your access to and use of https://www.superlinerusa.com (the "Site"), our products, and any related services (collectively, the "Services"). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site or Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a binding contract under U.S. law to use the Services. By using the Services, you represent and warrant that you meet these requirements.

2. Accounts

You may need to create an account to place orders or access certain features. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately of any unauthorized use at support@superlinerusa.com. We may suspend or terminate accounts that violate these Terms or applicable law.

3. Products, Pricing, and Availability

We make commercially reasonable efforts to display product information, colors, finishes, dimensions, and pricing accurately. However:

• Product images, swatches, and finishes are illustrative; minor variations may occur based on monitor calibration, lighting, lot, and manufacturing tolerances.
• Prices, promotions, and availability may change at any time without notice and are not guaranteed until your order is accepted.
• If we identify a pricing or descriptive error in your order, we may cancel the order and issue a full refund, even after order confirmation.
• Quantities may be limited; we may limit purchase quantities per person, household, order, or address.

4. Orders and Payment

Your order is an offer to purchase, which we may accept or decline at our discretion. An order confirmation email acknowledges receipt; the contract of sale is formed only when we ship the goods. We accept the payment methods listed at checkout. You authorize us and our payment processors to charge the payment method you provide for the total amount of your order, including taxes and shipping. Sales tax is calculated at checkout based on your shipping address.

5. Shipping, Returns, and Refunds

Shipping, return, and refund terms are set forth in our Shipping Policy and Return & Refund Policy, which are incorporated into these Terms by reference.

6. Vehicle Fitment, Installation & Modification Disclaimer

Our products are auto trim, decals, vinyl wraps, and vehicle accessories intended for use on motor vehicles. You are solely responsible for:

• Verifying year, make, model, trim, and any other compatibility data before purchase and before installation;
• Ensuring the product is appropriate for your intended use and complies with applicable federal, state, and local laws (including DOT regulations, window-tint and visibility laws, and emissions or safety regulations);
• Proper installation, surface preparation, and curing — we strongly recommend professional installation;
• Any impact on your vehicle’s manufacturer warranty resulting from product use or installation.

SUPER LINER is not responsible for installation labor, paint, clear-coat, glass, or other vehicle damage caused by improper installation, removal, or third-party products used in conjunction with ours. Race-, off-road-, or show-use-only items are sold for those purposes only and may not be legal for street use; you are responsible for compliance.

7. Intellectual Property

The Site and its content — including text, graphics, logos, product images, designs, software, and the SUPER LINER name and marks — are owned by or licensed to West Liners LLC and are protected by U.S. and international intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, scrape, or create derivative works without our prior written consent.

8. User Content

If you submit reviews, photos, comments, or other materials ("User Content") to the Site or our social channels, you grant us a worldwide, royalty-free, perpetual, non-exclusive, sublicensable license to use, reproduce, modify, publish, and display that User Content for our marketing and operational purposes. You represent that you have all rights necessary to grant this license and that the User Content does not infringe any third-party right.

9. Acceptable Use

You agree not to: (a) use the Site for unlawful purposes; (b) attempt to gain unauthorized access to our systems; (c) interfere with or disrupt the Site or servers; (d) use bots, scrapers, or other automated tools without permission; (e) misrepresent your identity or affiliation; or (f) use the Services to violate the rights of others.

10. Third-Party Links

The Site may contain links to third-party websites or services. We do not control and are not responsible for the content, policies, or practices of any third party.

11. Disclaimers

EXCEPT AS REQUIRED BY APPLICABLE LAW, THE SITE, SERVICES, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT PRODUCTS WILL FIT EVERY VEHICLE CONFIGURATION.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WEST LINERS LLC, ITS AFFILIATES, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO THE SITE, SERVICES, OR PRODUCTS, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM RELATED TO THE SERVICES OR A PRODUCT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions, our liability is limited to the maximum extent permitted by law.

13. Indemnification

You agree to defend, indemnify, and hold harmless West Liners LLC and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of these Terms; (b) your use of the Services or products; (c) your installation of any product on a vehicle; or (d) your violation of any law or third-party right.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. Subject to Section 15, the state and federal courts located in New Castle County, Delaware shall have exclusive jurisdiction and venue for any dispute that is not subject to arbitration.

15. Dispute Resolution — Binding Arbitration and Class Waiver

PLEASE READ CAREFULLY. THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, the Services, or any product (a "Dispute") will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that you may bring an individual action in small-claims court if it qualifies. The arbitration will take place in Delaware, or another mutually agreed location, and may be conducted by phone or videoconference where the rules allow. The arbitrator’s decision is final and binding.

Class Action Waiver. You and we agree that each may bring claims against the other only in your or our individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.

Opt-Out. You may opt out of this arbitration agreement by sending written notice to support@superlinerusa.com within 30 days of first accepting these Terms, including your name, address, and a clear statement that you wish to opt out.

16. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date above reflects the most recent revision. Material changes will be posted on the Site or communicated by email where appropriate. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

17. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to us or other users. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

18. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right or provision is not a waiver. These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the entire agreement between you and us regarding the Services and supersede prior agreements.
